Massachusetts Real Estate Agent Account – Terms & Conditions
These Terms & Conditions (“Terms”) govern the creation and use of a Real Estate Agent Account with Majano Group (“Company,” “we,” “us”) and are designed to comply with Massachusetts real estate laws and regulations, including oversight by the Massachusetts Board of Registration of Real Estate Brokers and Salespersons.
By checking the box on the website form and submitting your application, you (“Agent,” “you”) agree to be legally bound by these Terms.
1. Eligibility (Massachusetts Compliance)
By creating an account, you confirm that:
- You are at least 18 years old.
- You hold an active and valid Massachusetts real estate license (Salesperson or Broker) issued by the Massachusetts Board of Registration.
- You are operating under the supervision of a licensed Massachusetts real estate broker, if required by law.
- Your license is in good standing and not suspended or revoked.
Majano Group reserves the right to verify licensing status at any time.
2. Independent Contractor Status
You acknowledge that:
- You are an independent contractor, not an employee of Majano Group.
- Nothing in these Terms creates an employment relationship, partnership, or joint venture.
- You are solely responsible for your own taxes, insurance (including E&O), continuing education, and licensing compliance.
3. Permitted Use of the Account
You agree to:
- Use the account only for lawful real estate activities permitted under Massachusetts General Laws Chapter 112.
- Comply with all applicable fair housing, anti-discrimination, advertising, and consumer protection laws.
- Maintain accurate, current, and truthful profile and license information.
You agree not to:
- Misrepresent properties, clients, your license status, or Majano Group.
- Engage in false, deceptive, or misleading advertising.
- Share, transfer, or allow unauthorized access to your account.
4. Advertising, Branding, and MLS Rules
- Any advertising using the Majano Group name or branding must comply with Massachusetts advertising regulations, MLS rules, and company branding guidelines.
- All advertisements must clearly identify the supervising broker where required by law.
- Majano Group may require modification or removal of non-compliant advertising.
5. Leads, Referrals, and Compensation
- Any leads or referrals provided through the platform are subject to Massachusetts law.
- No commissions or referral fees are earned or owed unless governed by a separate written agreement compliant with Massachusetts regulations.
- Majano Group does not guarantee the number, quality, or conversion of leads.
6. Fair Housing & Ethical Conduct
You agree to:
- Comply with Federal Fair Housing Act, Massachusetts Fair Housing Laws, and all anti-discrimination regulations.
- Treat all clients and members of the public fairly and without bias.
7. Data Privacy & Electronic Communications
- You consent to the collection and use of your information for account administration, legal compliance, and communication.
- You agree to receive account-related communications electronically (email, text, or phone).
8. Suspension or Termination
Majano Group may suspend or terminate your account if:
- Your license becomes inactive, expired, suspended, or revoked.
- You violate these Terms or applicable law.
- Your conduct poses legal, reputational, or compliance risk.
You may request account termination at any time.
9. Limitation of Liability
Majano Group is not liable for indirect, incidental, or consequential damages arising from your use of the platform, to the maximum extent permitted by Massachusetts law.
10. Indemnification
You agree to indemnify and hold harmless Majano Group from any claims or liabilities arising from:
- Your real estate activities.
- Violations of Massachusetts or federal law.
- Breach of these Terms.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
12. Electronic Acceptance (Checkbox Consent)
By checking the box and submitting the form, you confirm that:
- You have read and agree to these Terms & Conditions.
- You certify that your Massachusetts real estate license is active and in good standing.
- Your electronic acceptance constitutes a legally binding agreement.
